Pawtrait Maker Terms & Conditions
Use
Pawtrait Maker can generate 'Pawtraits' based on the style choices within the application. Each style is selected by the end user.
Pawtraits are defined as the images that are generated by Pawtrait Maker. These images are derived from the set of images uploaded by users. Pawtraits produced may not be entirely accurate and not be a true reflection of the samples on the website. Pawtraits are based on the quality and resolution of the images uploaded.
Images with low resolution or images that are too similar to one and other may result in poor quality or inaccurate Pawtraits.
Age Requirements
You must be at least 13 years old to use the service and meet the minimum age of digital consent in your country. If you are not old enough to consent to our terms of use in your country, your parent or guardian must agree to this agreement on your behalf. Please ask your parent or guardian to read these terms with you. If you're a parent or legal guardian, and you allow your teenager to use the services, then these terms also apply to you and you're responsible for your teenager's activity on the services. No assurances are made as to the suitability of the Pawtraits for you. By using the service, you represent and warrant that you meet this age requirement.
Use of Images
By uploading images of your pets to the service, you represent and warrant that you have the legal right to do so, including the right to grant us a non-exclusive license to use the images for the purpose of creating Pawtraits. You also agree that we have the right to remove any images that are reported to us as infringing on a third party's intellectual property rights.
Upload Guidelines
Pawtrait Maker should not be used for
- NSFW, lewd, or sexual material
- Hateful or violent imagery, such as antisemitic iconography, racist caricatures, misogynistic and misandrist propaganda, etc
- Copyrighted or trademarked material should be avoided in uploads.
Costing
To use Pawtrait Maker, you must purchase ability to generate Pawtraits. The cost of the Pawtraits and the terms of purchase are subject to change at any time.
Ownership of Pawtraits
To the extent allowed by law and as between you and Pawtrait Maker, you own your uploads and Pawtraits. Pawtrait Maker grants you the exclusive rights to reproduce and display such Pawtraits and will not resell Pawtraits that you have created, or assert any copyright in such way against you or your end users, all provided that you comply with these terms. If you violate our terms, you will lose rights to use Pawtrait Maker, but we will provide you written notice and a reasonable opportunity to fix your violation, unless it was clearly illegal or abusive. You understand and acknowledge that similar or identical Pawtraits may be created by other people using similar pets and styles, and your rights are only to the specific Pawtrait that you have created.
Storage Policy
Pawtrait Maker will store your images and Pawtraits for a period of 30 days. After this period, the images and Pawtraits will be deleted from our servers. We recommend that you save copies of your images and Pawtraits on your own devices. Pawtrait Maker can also delete images and Pawtraits upon request.
No Guarantees
Pawtrait Maker does not guarantee that the service will be error-free or uninterrupted. Pawtrait Maker will make all efforts to ensure that the service is functioning properly but can not guarantee that the service will be available at all times. Pawtrait Maker will not be liable for any damages resulting from the use of the service.
We plan to continue to develop and improve Pawtrait Maker, but we make no guarantees or promises about how Pawtrait Maker operates or that it will function as intended, and your use of Pawtrait Maker is at your own risk.
The service is provided on an "AS IS" and "AS AVAILABLE" basis. The service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance
Modification of Terms of Service
Pawtrait Maker reserves the right to modify these terms of service at any time. Your continued use of the service following the posting of any changes to these terms means that you accept those changes.
Limitation of Liability
To the maximum extent permitted by law, Pawtrait Maker will not be liable for any damages arising from the use of the service, including but not limited to special, incidental, indirect, or consequential damages, loss of profits, loss of data, or business interruption.
Indemnity Clause
You agree to indemnify and hold Pawtrait Maker and its affiliates, officers, agents, and employees harmless from any claims, demands, or damages, including legal fees, arising out of or in connection with your use of the service, your violation of these terms of service, or your violation of any rights of another.
